ANNOUNCE THAT WE DO HAVE A QUORUM PRESENT TONIGHT.

ALLEN VFW POST 2195 IS GOING TO BE PRESENTING THE COLORS THIS EVENING.

[3.1 Presentation of a Blue Star Flag to family members of Allen service personnel currently serving in the U.S. Armed Forces.]

ONE OF THE BEST THINGS THAT I THINK THE CITY OF ALLEN HAS EVER DONE IS TO DO THE BLUE STAR PROGRAM.

I'LL TELL YOU A LITTLE BIT ABOUT THAT.

THE BLUE STAR PROGRAM IS A PROGRAM THAT WAS STARTED BACK IN 1917 DURING WORLD WAR I.

THERE WAS AN ARMY CAPTAIN NAMED ROBERT QUEISSER WHO HAD TWO SONS WHO WERE SERVING OVERSEAS IN WORLD WAR I.

HE THOUGHT THAT IT WOULD BE A GOOD IDEA TO HAVE SOME SYMBOL TO REPRESENT THE FACT THAT HE HAD TWO SONS SERVING IN THE ARMED FORCES.

SO HE CREATED THE BLUE STAR THAT WE KNOW OF TODAY.

WELL, LATER IT BECAME VERY POPULAR DURING WORLD WAR I AND HE ACTUALLY PATENTED THE IDEA, WHICH WAS A GOOD THING FOR HIM BECAUSE IT EVENTUALLY BECAME ADOPTED BY THE US GOVERNMENT AND HAS BEEN A VERY STRONG PROGRAM EVER SINCE.

THE CITY OF ALLEN DID THIS ABOUT 20 YEARS AGO AND FOR SOME REASON IT JUST STOPPED FOR A WHILE.

BUT WE'VE RESTARTED IT HERE IN THE LAST YEAR-AND-A-HALF, AND I'M GLAD THAT WE DID THAT.

THE GREAT THING ABOUT IT IS, IS THAT MOST PEOPLE DON'T RECOGNIZE OR KNOW WHEN FAMILIES IN OUR COMMUNITY HAVE LOVED ONES THAT ARE SERVING IN THE ARMED FORCES.

BEING ABLE TO FOLLOW THAT TRADITION OF DISPLAYING THE BLUE STAR IN A WINDOW AT YOUR HOME SO WHEN PEOPLE DRIVE BY YOUR HOUSE, THEY CAN SEE AND RECOGNIZE THAT YOU'RE IN THAT CATEGORY.

THE GOOD THING ABOUT THAT IS, IS THAT WE NEED TO RECOGNIZE THAT WHEN INDIVIDUALS HAVE LOVED ONES SERVING IN THE ARMED FORCES, THAT THEY GO THROUGH A LOT OF TRIALS AND TRIBULATIONS THAT MOST PEOPLE DON'T.

WHEN YOU HAVE A LOVED ONE THAT'S SERVING OVERSEAS, YOU DON'T KNOW WHAT THEIR STATUS IS, YOU CAN'T COMMUNICATE WITH THEM ALL THE TIME.

THEY MAY BE OUT IN THE WILDERNESS SOMEPLACE.

YOU NEVER KNOW WHERE THEY ARE AND THEY'RE IN HARMS WAY.

THIS IS A GOOD WAY TO RECOGNIZE THEM, TO RESPECT THEM, AND THEN ALSO TO BE A FRIEND TO THEM IN THEIR TIME OF NEED.

WITH THAT, WE HAVE ONE BLUE STAR THAT WE'RE GOING TO ISSUE TONIGHT.

I DIDN'T WANT TO SAY THAT THE BLUE STAR FLAG ACTUALLY COMES WITH UP TO FOUR STARS.

WE HAVE HAD AT LEAST ONE OR TWO PEOPLE IN THE CITY OF ALLEN THAT HAVE HAD FOUR STARS ON THEIR BLUE STAR FLAG.

WE HAVE SOME VERY DEDICATED PEOPLE IN OUR COMMUNITY, ESPECIALLY WITH THEIR YOUTH THAT ARE SERVING IN THE ARMED FORCES.

YOU CAN ACTUALLY GET MORE IF YOU WANT THEM.

BUT THE STANDARD IS FOUR.

IF YOU WANT TO GET IT CUSTOMED AND DO FIVE OR SIX OR SOMETHING LIKE THAT, YOU CAN DO THAT AS WELL.

TONIGHT I'M GOING TO INVITE THE FAMILY OF GRACE CARNLEY TO COME FORWARD AND WE WILL PRESENT THEM WITH A CERTIFICATE AND THEIR BLUE STAR.

WHEN PEOPLE SAY WHY, SHE'S LIKE, WHY NOT ME.

I'M VERY PROUD OF HER AND SHE IS IN THE MARINE CORPS SCHOOL FOR AIR CREW RIGHT NOW.

SHE'S LEARNING TO SERVE IN THAT CAPACITY.

SHE WAS IN ACTUALLY PARRIS ISLAND, SOUTH CAROLINA BOOT CAMP.

BUT IT TOOK HER 14 MONTHS TO GET THROUGH BOOT CAMP BECAUSE OF TWO INJURIES AND SHE REFUSED TO GIVE UP.

I'M JUST REALLY PROUD AND I'M VERY GRATEFUL FOR THE CITY OF ALLEN FOR ALLOWING US TO BE HONORED THIS WAY AND FOR GRACE TO BE RECOGNIZED.

WE CONSIDERED REQUEST FOR VARIANCE TO MAXIMUM SIZE OF A TEMPORARY ACCESSORY BUILDING FOR A PUBLIC SCHOOL PERMITTED IN ALLEN LAND DEVELOPMENT CODE SECTION 6.04.2.4.E, GENERALLY LOCATED APPROXIMATELY A 152 FEET NORTH OF ALMA DRIVE AND DIRECTLY WEST OF TATUM DRIVE, ERECKSON MIDDLE SCHOOL.

THIS REQUEST WAS APPROVED BY THE BOARD.

SECOND BOARD HERE IS THE BUILDING AND STANDARDS COMMISSION.

OFTENTIMES WE BECOME FOCUSED IN ON NATIONAL ISSUES, WHETHER IT'D BE WITH FEDERAL, STATE, AND EVEN COUNCIL MEMBERS AND MAYOR, AS YOU KNOW, YOU-ALL TAKE A POSITION WHEN YOU GET ONTO A COUNCIL, ON A BOARD OF GOVERNMENT AND A BODY AND YOU'RE REALLY FOCUSED ON WHAT'S THE ISSUES THAT ARE IMPORTANT TO YOU.

OFTENTIMES THIS IMPORTANT PIECE OF THE GOVERNMENT CAN BE OVERLOOKED.

WE'VE GOT 254 COUNTIES IN THE STATE OF TEXAS, AND WHAT'S UNIQUE ABOUT EACH ONE IS THAT THEY HAVE FOUR COMMISSIONERS AND THEY HAVE A COUNTY JUDGE.

IF YOU THINK ABOUT THE WAY THAT THE CITY OF ALLEN'S BROKEN UP, YOU'VE GOT YOUR LEGISLATIVE BODY, WHICH IS YOUR COUNCIL MEMBERS AND YOU'VE GOT YOUR MAYOR, WHICH WOULD BE CONSIDERED MAYBE YOUR EXECUTIVE BRANCH, IN A SENSE.

WHEN YOU LOOK AT THE COUNTY COMMISSIONERS COURT, EACH ONE IS BROKEN UP SIMILAR IN WHICH YOU'VE GOT FOUR COMMISSIONERS MAKE UP YOUR LEGISLATIVE BODY AND THEN YOU'VE GOT YOUR COUNTY JUDGE THAT ALSO HAS THE ABILITY TO VOTE AMONGST THAT BODY.

THE MISSION OF THE COMMISSIONERS COURT IS TO DELIVER JUSTICE, PUBLIC HEALTH, PUBLIC SAFETY, AND INFRASTRUCTURE AS DEFINED BY THE STATE OF TEXAS.

WHEN WE THINK ABOUT ROADS, WHEN WE'RE THINKING ABOUT THE PUBLIC HEALTH, RESPONDING TO MENTAL HEALTH, THESE ARE ALL INSTANCES AND SITUATIONS IN WHICH THE COUNTY IS RESPONSIBLE FOR.

WE WILL LOOK AT THE BREAKDOWN; THE COUNTY JUDGE, SIMILAR TO THE MAYOR, IS RESPONSIBLE FOR THE EMERGENCY MANAGEMENT RESPONSE THAT OCCURS THROUGHOUT THE COUNTY.

THIS COULD INCLUDE INSTANCES OF NATURAL DISASTER, COULD INCLUDE INSTANCES OF PUBLIC HEALTH RELATING TO A PANDEMIC, IT COULD INCLUDE INFRASTRUCTURE FAILURES LIKE IF WE HAD A FREEZE AND THERE WAS AN EMERGENCY RESPONSE THAT WAS NEEDED FOR THAT.

THEY'RE ON THE SIDEWALK IN FRONT OF THEIR HOUSE OR IN FRONT OF THEIR NEIGHBOR'S HOUSE.

IT CONTINUES ATTENDING ANY TYPE OF RELIGIOUS ORGANIZATION OR EVENT, ATTENDING AN ACTIVITY SUPERVISED BY ADULTS SPONSORED BY THE CITY, A SCHOOL, CIVIC ORGANIZATION, OR GOING TO OR RETURNING HOME WITHOUT ANY DETOURS OR STOPS.

JUVENILE WAS EXERCISING THEIR FIRST AMENDMENT RIGHTS OF RELIGION, FREEDOM OF SPEECH, AND/OR ASSEMBLY, AND IS MARRIED AND HAS BEEN EMANCIPATED BY THE COURTS.

UNLESS THERE ARE EXTENUATING CIRCUMSTANCES, TYPICALLY, OFFICERS HAVING A FIRST ENCOUNTER WOULD ISSUE A WRITTEN WARNING.

A SECOND OFFENSE MAY RESULT IN A CITATION, THIRD AND SUBSEQUENT OFFENSES COULD LEAD TO A JUVENILE BEING TAKEN INTO CUSTODY, DETAINED.

[NOISE] AS STATED BEFORE, OFFICERS WILL NOT STOP A VEHICLE DURING CURFEW HOURS JUST TO SEE IF HE OR SHE IS A JUVENILE, STOP A JUVENILE AT A CONVENIENCE STORE DURING CURFEW HOURS, WHEN THEY MAKE A PURCHASE AND LEAVE, THEY'RE JUST CONDUCTING A TRANSACTION, AND THEY WILL NOT STOP A JUVENILE WHO'S EATING AT A RESTAURANT AND MERRILY GETS UP WHEN THEY'RE DONE AND PAYS THEIR BILL AND LEAVES.

OVER THE LAST THREE YEARS, TWO CITATIONS WERE ISSUED IN 2019, EIGHT IN 2020, FIVE IN 2021, 15 TOTAL CITATIONS.

WE ALSO HAVE JUVENILE FIELD INTERVIEWS SIMPLY AS DOCUMENTATION THAT WE MADE CONTACT.

THERE'S SOME STATUTORY REQUIREMENTS IN CERTAIN CASES TO DO JUVENILE FIELD INTERVIEWS, ESPECIALLY IF WE TAKE A JUVENILE INTO CUSTODY FOR ANOTHER REASON.

AS YOU CAN SEE, IN 2021, PLUS OR MINUS A FEW POINTS, BEING ABOUT 10 PERCENT OF THE TOTAL JUVENILE FIELD INQUIRIES THAT WE WROTE.

THESE ARE MORE OR LESS WARNINGS.

THEY'RE JUST DOCUMENTATION THAT WE INTERACTED WITH A JUVENILE.

IF YOU REALLY THINK A CURFEW PREVENTS CRIME, THEN YOU WOULD IMPLEMENT IT FOR EVERYONE.

BUT WE ALL KNOW HOW THAT'S NOT GOING TO OVER VERY WELL IN THE COURTS.

NOW, I'M ALSO A PARENT AND AS A PARENT IT IS MY RIGHT TO DECIDE HOW TO RAISE MY CHILDREN, NOT THE FEDERAL GOVERNMENT, NOT THE STATE, AND NOT YOU.

IF MY CHILDREN COMMITTED A CRIME, THEN I SHOULD BE HELD ACCOUNTABLE.

THEREFORE, IT IS MY RESPONSIBILITY TO MAKE SURE THAT THEY STAY OUT OF TROUBLE.

IN THE ORDINANCE, THE FIRST AMENDMENT IS CLEARLY DEFINED AS A DEFENSIBLE CAUSE WHICH SHOULD AUTOMATICALLY NULLIFY THE ENTIRE ORDINANCE.

ANOTHER STATISTIC THAT YOU'LL QUICKLY FIND IS THAT NIGHTTIME CRIME RATES ACTUALLY INCREASE ACROSS THE NATION WHEN CURFEW LAWS STARTED BEING PUT IN.

THIS WAS DUE TO LESS WITNESSES BEING ON THE STREETS.

REPEALING THOSE CURFEW LAWS SAW A DROP IN CRIME RATES.

FINALLY, CURFEW VIOLATIONS ARE A STATUS OFFENSE, WHICH MEANS THEY CRIMINALIZE BEHAVIOR THAT IS ONLY ILLEGAL BECAUSE THE PERSON IS UNDER THE AGE OF 18.

I LOOKED AT THE STATISTICS AND THERE IS A HUGE STUDY TAKING 7,000 CITIES.

SEVEN THOUSAND THAT HAD THESE ORDINANCES AND THERE WAS NO CHANGE IN CRIME.

SOME OF THEM DID HAVE LESS CRIME IN THE EVENING HOURS DURING THE CURFEW, BUT THAT WAS ACTUALLY ELEVATED DURING THE DAYTIME.

CRIME OVERALL DIDN'T CHANGE, AND QUITE FRANKLY, THAT THE LARGEST STUDY, WHICH WAS CALLED THE CAMPBELL COLLABORATION, I BELIEVE. YOU CAN LOOK IT UP.
